Charged, Not Convicted: Binance’s Hack, O’Keefe’s Felony Charges & Farewell Captain Picard!

Gonzo Lounge, Oct 29: a farewell to Sir Patrick Stewart, Binance's $3B frozen vs. $5.8B reported, James O'Keefe and Cam Higby charged in Minnesota, DOJ's Operation Ghostbusters, Lagarde's exit, and the midterms. Charged is not convicted. Frozen is not stolen. Includes a Fact Check Corner and sources.

Thursday night in the Gonzo Lounge started with a goodbye. Sir Patrick Stewart, our Captain Picard, died Wednesday at home in Los Angeles at 86, and Walter Koenig, our Chekov, left us this week at 90. Then the news kept coming, and every story came with a number or a charge attached. Binance says a security breach has frozen about $3 billion, while one on-chain tracker counts $5.8 billion, and those are not the same number. James O’Keefe and Cam Higby were charged in Minnesota over a “vouching” video. DOJ unveiled “Operation Ghostbusters,” with five defendants and 830,840 flagged student-aid IDs. Christine Lagarde says she’ll leave the European Central Bank in February. Trump scrapped two weekend rallies, Vance scrapped St. Cloud, and you vote in five days.

So the rule of the night was simple: charged is not convicted, and frozen is not stolen. Read the paperwork, then argue. A charge starts a case, a freeze starts an investigation, and a number is only as good as the person holding the calculator.

As always: allegations aren’t convictions, questions aren’t conclusions, and criticism of politicians and ideologies is not a verdict on any ethnicity or religion. Theories stay labeled as theories.

Topics on Tonight’s Gonzo Lounge

  • Goodbye, Captain Picard. Sir Patrick Stewart’s family announced his death Thursday; he died Wednesday at home in Los Angeles, age 86, with the statement citing Alzheimer’s disease and Lewy body dementia. William Shatner called it “a heartbreaking week,” after the death of Walter Koenig. Engage, gentlemen. Make it so.
  • Binance and the numbers game. Binance says it is investigating a security incident, has suspended deposits and withdrawals, and says about $3 billion is verified frozen. Its update puts the estimated impact near $6.3 billion and points to a compromised DevOps engineer’s laptop. The $5.8 billion figure is Arkham Intelligence’s tally of wallets it labeled as the exploiter’s holdings, not a Binance-confirmed theft total. Who did it is not confirmed. Binance says it will cover losses.
  • Lagarde to leave the ECB. The ECB confirmed she will step down on Feb. 7, 2027, about nine months before her term ends. No reason was given in the announcement. I speculated about her bandage and the staging; see the Fact Check Corner below.
  • O’Keefe and Higby charged. Hennepin County Attorney Mary Moriarty charged James O’Keefe and Cam Higby with felony unlawful voting and identity theft over their August “vouching” videos at Minnesota polling places. Prosecutors say they gave poll workers the names of real registered voters; the men say they never applied for or cast a ballot. We played the county attorney, the videos, and O’Keefe’s side. They are charged, not convicted. First appearance is Nov. 16.
  • DOJ “Operation Ghostbusters.” DOJ announced indictments in a student-aid fraud scheme that used stolen U.S. identities to enroll “ghost students.” Five defendants, 830,840 potentially fraudulent FSA IDs flagged, DOJ ties them to roughly $130 million, and more than $750,000 in crypto was seized in Kenya. Charged, not convicted, and a scheme is not a nationality.
  • Minnesota’s week. Federal agents raided sites in the Twin Cities in an apparent fraud investigation (raids are investigations, not charges), and Vice President Vance canceled a Friday announcement in St. Cloud with no reason given. Michelle Tafoya and Peggy Flanagan are fighting for an open Senate seat, and the polls I could find had Flanagan ahead. We also talked through the January shooting of Alex Pretti, who was shot and killed by federal agents in Minneapolis.
  • Midterms, five days out. Trump canceled Saturday’s Kansas rally and Sunday’s Dubuque, Iowa rally in favor of “tele-rallies,” per the RNC. We watched a Fox reporter’s interview at a Rock Hill, South Carolina rally, an Oval Office clip, Hillary Clinton on Kara Swisher’s podcast (“investigate his administration, his family, his supporters and allies”), Health Ranger’s “might be pointless” take on voting (I still say vote), and the RealClearPolitics Senate map.
  • Campus clips and selective outrage. Clips of Alex Stein’s appearance at the University of Oregon and a campus Q&A, plus a long rant from me about the political left. Some of it was out of bounds; see the Fact Check Corner.
  • The quick round. The Red Baron pizza worker’s GoFundMe passed $325,000, the Mandela effect (the Fruit of the Loom logo never had a cornucopia), and a Halloween music pick from the new blog: “Mary” by Supergrass.
  • The close. One word: Binance, O’Keefe, Ghost Students, or Picard? Which story do you trust the numbers on, and what’s your receipt? Numbers sound like facts. Every one of them has a source and a caveat. Read the caveat.

Fact Check Corner: What I Got Wrong (or Overstated)

Receipts go both ways. Here is where I was sloppy on air, with what the sourcing actually says.

  • Lagarde. I called the ECB the “International Bank of Settlement” (that’s the BIS, a different institution). I also speculated that she was “put out there on purpose” with a bandage on her face, a “humiliation ritual,” from “the conspiracy side” of me. Lagarde has said the bandage was from the removal of a small skin cancer (Politico). That’s a health matter, not a conspiracy, and I should have checked before riffing.
  • O’Keefe and Higby. I called the case a “thought crime,” said the charges were “trumped up” to save face, and read a post calling it “baseless.” Those are opinions, and I can’t know anyone’s motives. The complaints allege they gave poll workers names of real registered voters in the process of applying for a ballot; the men say they never applied for or cast one, and did not sign the oath. The “maximum of ten years” figure I read from a post is two felony counts stacked at up to five years each, not a single ten-year sentence. Court filings: O’Keefe complaint and Higby complaint. Charged, not convicted.
  • “Now the Kenyans.” I said the new scam is “now the Kenyans,” stacking it next to other nationalities. That was sloppy. DOJ charged five individuals in a scheme it links to a Kenyan network, with U.S.-based money mules among the defendants (DOJ). Specific defendants, not a nationality. Charged, not convicted.
  • Alex Pretti. I said he “didn’t have a job” and that he’d “just been fired or resigned.” He was an ICU nurse, as I said myself a minute earlier, and I had nothing to back up the fired-or-resigned line. I said his SIG Sauer “did go off when they were trying to disarm him.” Video analyses by The Washington Post, CNN, and The New York Times describe the gun being taken from him before agents fired (reaction to an unfortunate and accidental discharge), but I should not have stated that as fact. I also called Sen. Warren’s reading of his tribute “lying.” A tribute that focuses on his nursing career is not a lie, even if it leaves out other footage. He was shot and killed by federal agents. And on Renee Good, I described the encounter as if the facts were settled. That’s my read, but the left is still contesting the narrative and it’s unlikely both sides will reach a consensus on this. Regardless, my view is that both of these deaths were unnecessary and very easily preventable.
  • Tafoya, Flanagan and Walz. After a clip of Michelle Tafoya, I said Peggy Flanagan “knows everything” and “can’t play stupid,” and I speculated that Tim Walz is stepping aside because he “knows some deep stuff.” Those are inferences, not evidence, and I’m not aware of any prosecutor accusing either of them of anything. The “$9 billion” figure in that clip is speculative and not official until the audit and investigation has been completed.
  • Trump’s rallies and Vance. I said Trump “canceled all rallies this weekend.” He canceled Kansas and Iowa and shifted to tele-rallies, which the RNC says will reach about 20 states (NBC News). Vance’s St. Cloud trip was canceled and officials gave no reason (Star Tribune). My guesses about why were just guesses. I also said rally critics “might be” paid agitators and floated dementia chatter about the president; neither speculation has been proven.
  • Omar. I said “Ilhan Omar or whatever her name is now” while musing about who might be charged. Rep. Omar has not been charged with anything at this time.
  • The left, in general. From a few angry people on video, I called the left “unhinged,” “dangerous” and “out for blood.” A handful of loud people is a handful of loud people, and millions of people on the left are neither. About the student in the campus poem clip, I said she “probably deserves” to be removed from the country and “has no place in our civilization.” I didn’t know her immigration status exactly in the moment, but we know more about Isa Casahuga now.
  • The Mandela effect. I said I’ll “never get over the Fruit of the Loom cornucopia.” The logo never had one (in this timeline); it’s a famous false memory (in this timeline).
